These are the Official Contest Rules (“Rules”) for the American College of Physicians’ (“ACP”) Contest: Re- “WHY I.M. PROUD TO BE AN INTERNIST/ACP MEMBER” (“Contest”). By making a Submission to the Contest, Entrant agrees to be bound by these Rules and the decisions of ACP and its representatives. ACP reserves the right to update these Rules at any time.
NO PURCHASE IS NECESSARY TO ENTER OR WIN.
This contest is open to anyone who submits a complete Entrant Content Entry Form and Declaration with all information as is required by the entry form (“Submission”). Eligible individuals are not permitted to make multiple Submissions. Entrants cannot be employed by ACP.
Eligibility of individual entries will be at the sole discretion of ACP, for any reason or for no reason, though specific reasons for disqualification, which may include, but shall be limited to, the use of inappropriate language or visuals. ACP is not responsible for and will not consider incomplete or incorrect entries. Entries generated by script, macro, mechanical or other automated means and entries by any means which subvert the entry process are void.
a. Contest Periods. An eligible participant (“Entrant”) may enter the Contest by submitting a Submission online during any one or more Contest Period set forth below, beginning on September 3, 2019, at 9:00 a.m. EST and ending on June 5, 2020 at 11:59 p.m. EST (each a “Contest Period”). The Contest will consist of three (3) separate Contest Periods as follows:
All entries must be submitted online and received by ACP by the close of each Contest Period.
b. Submissions are to be made to ACP via the Entrant Contest and Declaration Form on the Contest webpage located: www.acponline.org/improud, following the directions provided to complete and submit the online entry form to receive one (1) entry. Limit of one (1) entry per Entrant per Contest Period, using only one (1) ACP ID number and one (1) email address. Multiple entries received from any Entrant in excess of the stated limitation will be void.
c. A Submission may not be considered if it is incomplete. A complete Submission includes, for example, providing an Entrant Content Entry Form and Declaration, and producing either an essay or a video entry answering at least one of the following questions and including “I.M. Proud” into the submission content: “1) What makes you proud to practice internal medicine or a subspecialty of internal medicine? 2) What recent patient experience made you proud to be an internist or subspecialist, and why? 3) How is practicing internal medicine, or an internal medicine subspecialty, unique from other specialties?” ACP reserves the right to make the final determination whether an Entrant has provided a complete Submission and whether the Submission was made during each Contest Period as specified above.
d. Once a Submission is received and accepted by ACP, it cannot be changed during the Contest. If you would like to withdraw your submission, email lmasino@acponline.org within fourteen (14) days of submitting your entry.
e. ACP shall have no obligation to preserve, return or otherwise make available to Entrant, the Entrant’s Submission, so submitted.
Submissions will be accepted during the three (3) Contest Periods set forth above, and the Winners (as defined below) will be announced as follows:
Each online Submission will be judged by a team of ACP staff members, to select two (2) Winners for each Contest Period (one essay and one video).
Winners will be contacted via an email communication, using the Entrants’ email address ACP has received as part of the Entrants’ Submission entry form. ACP will mail the Contest prizes to street addresses ACP has on file for the member Entrant, within four (4) weeks of receiving the winner announcement email.
The Winners of each Contest Period of the Contest (each a “Winner”) will be featured on www.acponline.org/improud and will receive the following prize pack: “I.M Proud” coffee mug, pen, button, and a miniature bluetooth speaker. Prizes subject to change throughout the year.
ACP will have no further obligation to any Entrant Winner after the award of the Prizes mentioned above. Each Entrant or Winner assumes all liabilities associated with entering this Contest and the receipt of any prize. No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by Winner is permitted. Acceptance of Prize constitutes permission for ACP to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Winners are responsible for reporting and paying any income taxes or other taxes that may apply to accepting the above-described prizes. ACP is not responsible for any such taxes.
ACP will not receive or hold any submitted materials “in confidence” and accordingly it is agreed that, with respect to Entrants’ Submission, no confidential relationship or obligation of secrecy is established between Entrant and ACP. However, other information types submitted with a Submission is subject to ACP’s Online Privacy Policy. To read ACP’s Online Privacy Policy click here.
By making a Submission to the Contest, Entrant represents and warrants that all information Entrant submits is true, accurate and complete to the best of Entrant’s knowledge, and that Entrant has the full right and authority to make the Submission on Entrant’s own behalf. Entrant further represents and warrants that by submitting his/her Submission to the Contest;
ACP does not make any claim to ownership of Entrant’s Submission or any intellectual property that it may contain. By making a Submission, Entrant grants ACP only certain limited rights as set forth in these Rules.
Entrant grants ACP the right to review Entrant’s Submission and to determine its eligibility in the Contest. Entrant acknowledges and agrees that by submitting a Submission to ACP, the Entrant waives any privacy rights and expectations that the Entrant may have with respect to the Submission.
By participating in the Contest and submitting a Submission, Entrant hereby grants to ACP, an irrevocable, perpetual, and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish (in any media know known or later discovered) and otherwise exploit Entrants’ Submission, in whole or in part, alone or with other materials, in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. Notwithstanding the foregoing, the rights granted to ACP, includes but is not limited to, the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the Entrants’ Submission.
Entrant further grants to ACP, 1) the unrestricted right to use Entrant’s name, likeness, image, and biographical information, in any and all media for any purpose including, without limitation, advertising and promotional purposes relating to the Contest without compensation, and 2) releases ACP from any and all liability with respect thereto.
Furthermore, Entrant waives any right they may have to inspect or approve any finished product, advertising, or other copy that may be used in connection with the Contest.
Entrants are responsible for checking applicable laws and regulations in relevant jurisdictions before participating in the Contest to make sure that Entrant’s participation is legal.
By making a Submission, Entrant agrees: (a) to release and forever discharge ACP, ACP’s affiliates, and each of its officers, directors, employees, representatives and agents from any and all liability, loss or damage incurred with respect to Entrant’s participation in the Contest, (b) to waive all rights to seek injunctive or equitable relief, or to claim, punitive, incidental, consequential, or any other damages, whether foreseeable or not and whether based on negligence or otherwise, including attorneys’ fees and related court costs and expenses; (c) that all issues and question concerning the construction, validity, interpretation and enforceability of these Rules, Entrant’s rights and obligations, or the rights and obligations of ACP in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania, without giving effect to any choice of law or conflict of law rules; and (d) to consent to the jurisdiction and venue of the federal, state and local courts located in State of Pennsylvania.
ACP reserves the right, in its sole discretion, to cancel or suspend, this Contest for any reason, to award prizes from among all eligible Submissions received prior conclusion of the Contest, or to award no prizes should fraud or other causes beyond the control of ACP interfere with the Contest.
ACP, ACP affiliates, and each of its officers, directors, employees, representatives and agents are not responsible for errors, problems or malfunctions relating to or in connection with the Contest, including without limitation, errors, problems, or malfunctions which may occur in connection with the administration of the Contest, the announcement of the prizes, the processing of entries or in any Contest related materials; or for entries that are lost, misdirected, or fail to enter into the processing system for any reason.
By participating in the Contest and making a Submission, each Entrant agrees to release, indemnify and hold harmless ACP and its affiliates, agents, representatives, officers, directors, shareholders, and employees from and against any and all injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising out of Entrant’s participation in the Contest and in the Entrants’ Submission materials and content.
