Decision in the Plank case
The Indiana Supreme Court issued its opinion in the Plank case on 1/15/13. The court ruled that, by failing to raise the constitutionality issue of the med mal statute until eight days after the jury had returned its verdict, Plank had forfeited the opportunity to conduct an evidentiary hearing on the statute’s constitutionality. Therefore the Plank case is over. However, the Court indicated in its opinion that the constitutionality of the statute might be challenged if raised appropriately at an earlier time in a case, assuming the plaintiff could produce evidence showing why changes over the past 30 years have caused the statute to become unconstitutional. Therefore, the issue will likely come up again in the future.
