Florida Chapter Wins Permanent Injunction Against Physician Gag Law

After over a year of litigation, the Florida Chapter and its allies won a permanent injunction prohibiting the State of Florida from enforcing the 2011 law that forbade physicians from discussing a patient’s gun ownership. In finding the law unconstitutional, the U.S. District Court relied heavily on the Chapter’s argument that any such law was an unconstitutional abridgement of a physician’s First Amendment right to free speech.

Changing to 5010 version of HIPAA Transactions scheduled for 1/1/12

Florida Medicaid’s fiscal agent - the Agency for Health Care Administration Alert - All trading partners will be deactivated for HIPAA standard 4010 X12 transactions effective January 1, 2012.

Changing to the 5010 version of the HIPAA transactions is vital for Florida Medicaid providers to be able to appropriately bill the Medicaid program for services rendered to eligible recipients. Failure to prepare for this deadline will result in delayed Medicaid payments. This change applies to any provider and vendor submitting or receiving electronic files from the Florida Medicaid program and its fiscal agent. Important Update from Chair of the Florida Board of Medicine

It is extremely important to keep your profile updated with the Florida Dept of Health. Physicians can be disciplined for not maintaining an updated profile. In addition to the basic information required by law, Awards, professional achievements, contributions, memberships, special qualifications etc. can also be voluntarily added to the profile. Also, by adding your e-mail to the listserve “mailman” will ensure you keep abreast of all the important changes in Laws and Rules as they happen. If you are not receiving the email updates from the Board of Medicine, we encourage you to check your profile and add your e-mail address to the listserve to receive the updates in time. Your e-mail address will NOT be shared from the listserve. The link and directions are below.

One of the Board of Medicine’s missions is to disseminate appropriate information to consumers and practitioners. In an effort to reach out to more applicants, licensees and the public to provide information, the Board has established a “Mailman” system. Each time the Board of Medicine posts new items in Mailman, subscribers receive an email including that information. Examples of the types of updates provided by the Mailman system includes changes in the law and board rules, reminders about legal requirements and updates that impact physicians and patients in Florida. Subscribers’ email addresses are not publicly displayed and are not posted onto the Board’s website or onto public practitioner profiles. You are encouraged to subscribe and instructions for how to sign up are below:

Instructions for Joining the Board of Medicine’s Mailman System
Step 1: Go to http://www.doh.state.fl.us/mqa/medical/index.html
Step 2: Select Interested Parties (Mailman) from the upper left side of the screen in the blue box
Step 3: Enter your email address where indicated
Step 4: Click on Subscribe

You will receive a confirmation of subscription. When the Board of Medicine posts information, you will receive an email with the posted information.
