American College of Physicians-American Society of Internal Medicine Product License Agreement and Limited Warranty for MKSAP® 12 Update CD-ROM: Individual Use

The materials contained within are protected by copyright. The material on this disk may be transferred to an electronic storage and retrieval system solely for the personal use of the purchaser of this disk. Permission for other uses must be obtained from the copyright owner.

  1. License and Restrictions on Use: User is granted a nontransferable, nonexclusive license to use this Software and the information contained in it for personal use, subject to the terms and conditions of this agreement. Software is licensed for individual use on a single computer.
  2. Ownership: Copyright and ownership of material included on this CD-ROM belong to ACP-ASIM unless otherwise noted. User may not (a) modify, network, loan, reverse compile, reverse assemble, reverse engineer, disassemble, or otherwise derive source code from the Software; (b) prepare derivative works of the Software; (c) copy the Software, except to make a single copy for archival purposes only; (d) rent or lease the Software; (e) use the Software in an on-line system; (f) use the Software in any manner that infringes the intellectual property or other rights of another party; or (g) transfer the Software or any copy thereof to another party unless user transfers all media and written materials, including the licensing agreement, in this package and retains no copies of the Software including prior versions of the Software for user's own use. Such other party shall be licensed under the terms of this Agreement upon its acceptance of the Agreement by its initial use of the product.
  3. Continuing Medical Education: The ACP-ASIM is accredited by the Accreditation Council for Continuing Medical Education (ACCME) to sponsor continuing medical education for physicians. The ACP-ASIM designates the MKSAP 12 Update for a maximum of 30 hours in Category 1 credit toward the AMA Physician's Recognition Award. Each physician should claim only those hours of credit that he/she actually spent in the educational activity.

    At the point of purchase, individual users are assigned a unique test identification number in order to receive CME credit and maintain their CME credit history. The unique test identification number is not transferable to other users. Sharing of test identification numbers would expose the subscriber's confidential CME credit history and account billing ledger, and disrupt tracking of the subscriber's CME credits. The ACP-ASIM disclaims all responsibility and liability for any improper or unauthorized use of an individual's unique text identification number.

  4. Limited Warranty: If the Software on this CD-ROM is found to be defective in workmanship or materials under normal use for 60 days from date of purchase, User is entitled to a replacement disk or refund of the full amount paid. These shall be the sole remedies available under this limited warranty. User should contact ACP-ASIM Customer Service (800-523-1546, ext. 2600, M-F, 9 AM - 5 PM EST) regarding defective disks. Questions regarding operation of the Software and other technical questions should be directed to the MKSAP 12 Update Help Line (888-965-3510, M-F, 9 AM - 5 PM EST).   5. Disclaimer: ACP-ASIM disclaims all warranties, express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose in connection with this disk, nor shall ACP-ASIM be liable for damages of any kind, including special and consequential damages, or other claims, arising out of the use of this disk or the data contained therein.

The Software is licensed to you on an "AS IS" basis without any warranty of any nature. The publisher shall not be liable for any damage or loss of any kind arising out of or resulting from your possession or use of the Software (including data loss or corruption), regardless of whether such liability is based in tort, contract or otherwise. If the foregoing limitation is held to be unenforceable, the publisher's maximum liability shall not exceed the amount of the license fees paid by you for the Software. The remedies available to you against the publisher under this agreement are exclusive. Some states do not allow the limitation or exclusion of implied warranties or liability for incidental or consequential damages, so the above limitations may not apply to you.

ACP-ASIM specifically disclaims any warranty, guarantee, or representation as to the correctness, accuracy, reliability, timeliness of contents, or use of this Software.
